California's Proposition 65, formally known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires businesses to provide a clear and reasonable warning before knowingly exposing individuals in California to chemicals identified by the State as causing cancer, birth defects, or other reproductive harm. The State of California maintains and periodically updates a list of these chemicals, which currently includes approximately 900 substances.
This page explains why you may encounter a Proposition 65 warning on our helmets, accessories, and related products, and describes how we address these requirements.
A Proposition 65 warning is a notification, not a determination that a product is unsafe or that it violates any product safety standard. The presence of a warning indicates that a product may result in exposure to one or more listed chemicals. Proposition 65 applies to any exposure above the State's established "safe harbor" levels, and the law does not provide a minimum quantity exemption. The purpose of the warning is to enable California residents to make informed decisions regarding their exposure.
Helmets and accessories are manufactured from a range of materials, including plastics, foams, adhesives, coatings, textiles, and metal components. Certain of these materials may contain trace amounts of chemicals included on the Proposition 65 list. Chemicals that are commonly associated with products in these categories include, without limitation:
The specific chemical or chemicals applicable to a given product will be identified in the warning displayed on that product, its packaging, or its product listing.
The following represents the form of warning provided for applicable products. The chemical or chemicals named will correspond to those identified in the relevant product.
WARNING: This product can expose you to chemicals including [chemical name], which is known to the State of California to cause [cancer / birth defects or other reproductive harm]. For more information, go to www.P65Warnings.ca.gov.
Where required, the warning is accompanied by the designated warning symbol, the signal word "WARNING" in bold capital letters, at least one named chemical for each applicable category of harm, and the reference to www.P65Warnings.ca.gov, in accordance with the State's safe harbor regulations.
We provide Proposition 65 warnings for products offered for sale to customers in California where such warnings are required. Warnings are applied based on [supplier disclosures and/or product testing], through which we seek to identify the presence of listed chemicals in our products. We work with our suppliers and manufacturers to obtain relevant chemical information and to apply warnings accordingly.
For further information regarding Proposition 65, the list of regulated chemicals, and measures for reducing exposure, please refer to the official State of California website at www.P65Warnings.ca.gov. Chemical-specific fact sheets are available at www.P65Warnings.ca.gov/fact-sheets.
The information provided on this page is for general informational purposes only and does not constitute legal advice. Product warnings are subject to change as chemical listings, regulatory requirements, and product compositions are updated.
